Report: the Intersection of Criminal Justice, Family Law and Law Child Care re DV & sexual violence

Published: Wednesday, May 03, 2023

Read the Report on the Intersection of the Criminal Justice, Private Family Law and Public Law Child Care Processes in relation to Domestic and Sexual Violence, commissioned by NWC in collaboration and funded by the Department of Justice. The research is an important recommendation of the Third National Strategy on Domestic, Sexual and Gender Based Violence and focuses on how acts of domestic or sexual violence can cause the activation of two and sometimes three distinct legal processes (the criminal justice process, the private family law process and the public law child care process) involving the same victim or victims and the same alleged perpetrator; and endeavours to consider how a more victim-centred collaborative approach can be adopted between the various legal processes. The recommendations of the report will inform the implementation of the Strategy particular with regard to the Protection and Prosecution Pillars and the reform of our Family Court System.
